Terms of Service
1. Acceptance of Terms
By downloading, accessing, or using the TourSmart mobile application (“App”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the App. TourSmart is operated by Jamie Harrison Media Ltd. (“Company,” “we,” “us,” or “our”).
2. Description of Service
TourSmart is a tour management application designed to assist artists and managers with itinerary planning, venue research, contract generation, and tour logistics. The App utilizes artificial intelligence and third-party data sources to provide information and generate content.
3. User Accounts
Registration: To access certain features of the App (such as cloud sync and AI-powered tools), you must create an account using a valid email address and username.
Security: You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.
Termination: You may delete your account at any time via the Settings menu in the App. We reserve the right to suspend or terminate accounts that violate these Terms.
4. Subscriptions and Credits
Subscription Model: TourSmart is offered exclusively through paid subscription plans. We do not offer standalone or one-time credit purchases.
Included Credits: Each subscription plan includes a defined allocation of credits, which are used to access certain AI-powered features (such as venue enrichment, itinerary generation, or content creation).
Credit Usage: Credits are consumed when a supported action is successfully completed. Unused credits do not expire while your subscription remains active.
Payments: All subscription payments are processed through the applicable app store provider (Apple App Store or Google Play Store). Prices may include applicable taxes, depending on your location.
Cancellations and Refunds: Subscription fees are generally non-refundable once charged. You may cancel your subscription at any time before the renewal date to avoid being charged for the next billing cycle. Your subscription will remain active until the end of the current billing period.
5. Third-Party Services and Data
The App integrates with third-party services to function. By using the App, you acknowledge and agree that:
- Artist Data: Artist and gigography data may be sourced from third-party providers such as Songkick.
- Location Data: Geocoding and map services are provided by OpenStreetMap (via Nominatim) and OSRM.
- AI Features: Content generation and data enrichment are processed using Google Gemini AI via our proxy server.
- Accuracy: We do not guarantee the accuracy, completeness, or timeliness of third-party data or AI-generated content. AI outputs may be incorrect, and you are responsible for independently verifying critical information (including venue details, capacities, and contacts).
6. User Content
Ownership: You retain ownership of all data you enter into the App, including tour details, notes, and uploaded documents.
License: By using the App and enabling data synchronization, you grant us a limited license to host, store, process, and back up your data solely for the purpose of providing the Service.
7. Prohibited Conduct
You agree not to:
- Use the App for any unlawful purpose.
- Reverse engineer, decompile, or attempt to extract the source code of the App.
- Use the App to harvest data in bulk, misuse AI features, or overload our servers or third-party services.
8. Disclaimer of Warranties
The App is provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied. We do not guarantee that the App will be uninterrupted, error-free, or secure. Any legal templates or contracts generated by the App are provided for informational purposes only and do not constitute legal advice.
9. Limitation of Liability
To the maximum extent permitted by law, Jamie Harrison Media Ltd. shall not be liable for any indirect, incidental, special, or consequential damages arising from or related to your use of the App, including loss of data, revenue, or business opportunities.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Republic of Ireland, without regard to its conflict of laws principles.
